Weiner & Sand LLC Files FCRA Lawsuit Against Trans Union

On March 19, 2018, Weiner & Sand LLC, on behalf of its client Morgan Dopson, filed a lawsuit in the United States District Court for the Middle District of Georgia against Trans Union, LLC.  According to the lawsuit, Trans Union violated the Fair Credit Reporting Act when it mixed information in Ms. Dopson’s credit file with information about a different consumer. As a result, Ms. Dopson’s credit file contained derogatory and inaccurate information that did not belong to her, including accounts, employment data, tradelines, and personal information.

Mixed files are a serious problem in the credit reporting industry. Mixed files occur when information relating to one consumer is placed in the file of another consumer. In other words, a “mixed file” occurs when information that relates to Consumer A appears in Consumer B’s credit file. Mixed files create a false description of a consumer’s credit history and can cause serious financial harm to a consumer’s credit.
