The Weiner Law Firm Files FCRA Case Against Ole Mexican Foods and S2 Verify

On January 18, 2016, The Weiner Law Firm filed a Complaint in the United States District Court for the Northern District of Georgia on behalf of our client, David Meriwether, against Ole Mexican Foods and S2 Verify.  Plaintiff alleges in the Complaint that Ole had hired him to be its Controller in November 2015.  He also alleges that Ole procured a background check from S2 Verify and that S2 Verify violated the Fair Credit Reporting Act when it furnished an inaccurate background report to Ole.  Plaintiff asserts claims against S2 Verify under 15 U.S.C. § 1681e(b) and 15 U.S.C. § 1681k.  Plaintiff further alleges that Ole' violated the Fair Credit Reporting Act when it did not give him an opportunity to review the background report, dispute its contents, or correct any inaccuracies before it terminated his employment. He asserts claims against Ole Mexican Foods under 15 U.S.C. § 1681b(b)(3).  In the lawsuit, Plaintiff seeks, among other things, actual and/or statutory damages, punitive damages, his costs, and his reasonable attorneys' fees as provided by 15 U.S.C. § 1681n and 15 U.S.C. § 1681o.  The case has been docketed as Case No. 1:16-cv-00159, N.D.Ga.
