Weiner & Sand Files Class Action Against Southern Metals Recycling

On August 24, 2018, Weiner & Sand LLC, on behalf of its client Carrie Donnelly, filed a proposed class action lawsuit in the United States District Court for the Southern District of Georgia against Southern Metals Recycling.  Plaintiff alleges that Southern Metals Recycling violated the Employee Retirement Income Security Act of 1974 (“ERISA”), as amended by the Consolidated Omnibus Budget Reconciliation Act of 1985 (“COBRA”), when it failed to provide Plaintiff and the proposed class members with adequate notice, as prescribed by COBRA, of their rights to continue their health coverage upon the occurrence of a “qualifying event” as defined by the statute.  The case is Donnelly v. Southern Metals Recycling, Inc., Case Number 4:18-cv-00200-RSB-GRS in the United States District Court for the Southern District of Georgia.
