Instacart, Pizza Hut, 7-Eleven, Papa John’s, Chipotle, GoPuff, FedEx, Dollar General, Dollar Tree, ByteDance, Netflix, G4S, Securitas, General Motors, and Fidelity are hiring; don’t let an erroneous background check stop you from being hired.

The news media is reporting that Instacart, Pizza Hut, 7-Eleven, Papa John’s, Chipotle, GoPuff, FedEx, Dollar General, Dollar Tree, ByteDance, Netflix, G4S, Securitas, General Motors, and Fidelity are hiring employees during this COVID-19 pandemic.  Many, if not all, of these employers will be running background checks on their new employees.

Sometimes, though, these background checks will come back with erroneous information.

-Maybe the background check included someone else’s criminal record as yours.  Sometimes it’s someone with the same or a similar name to yours, but sometimes it’s a completely different name.

-Maybe the background check reported you have a felony, when you actually have a misdemeanor.

-Maybe the background check will show that you have a conviction, when the charge was dismissed.

-Maybe the background check will show an adjudication of guilt, when you actually pled under a first offender’s statute.

In any of these cases, you may have rights under the Fair Credit Reporting Act.  If you’ve been denied employment because of an erroneous background check, feel free to reach out to the FCRA attorneys at Weiner & Sand LLC for a consultation.  There is no cost for the time.
