Equal Pay Act

Do you think your employer is violating your rights because it is paying you less than it is paying someone of the opposite sex for the same job?

Employee Rights

If an employer pays different wages to employees of opposite sexes for equal work on jobs requiring equal skill, effort, and responsibility, and which are performed under similar working conditions, then it may have violated the Equal Pay Act.

Employer Defenses

Generally, an employer can defend against its payment of different wages by pointing to one of the exceptions set forth in the EPA:

(i) a seniority system;

(ii) a merit system;

(iii) a system which measures earnings by quantity or quality of production; or

(iv) a differential based on any other factor other than sex.

If you believe that your employer may be violating the Equal Pay Act, please contact an employment attorney at Weiner & Sand LLC to discuss your compensation and wages.
