If an employer pays different wages to employees of opposite sexes for equal work on jobs requiring equal skill, effort, and responsibility, and which are performed under similar working conditions, then it may have violated the Equal Pay Act.
Generally, an employer can defend against its payment of different wages by pointing to one of the exceptions set forth in the EPA:
(i) a seniority system;
(ii) a merit system;
(iii) a system which measures earnings by quantity or quality of production; or
(iv) a differential based on any other factor other than sex.
